O R D E R

This Writ Petition is filed challenging the impugned refusal check slip dated 07.03.2026 issued by the second respondent and seeking a consequential direction to the second respondent to register the document presented by the petitioner dated 07.03.2026.

2. Upon perusal of the impugned refusal check slip, it can be seen that in view of the mandate under Section 34-C of the Registration Act, 1908, since the petitioner is not in a position to produce the original parent document, the refusal check slip has been issued.

3. In this regard, the learned Government Advocate appearing for the first and second respondents would submit that after Section 34-C of the Act has come into force, it is mandatory to produce the original parent document and therefore, the petitioner has to either produce the original or a non-traceable certificate.

If it is the case of the petitioner that the original parent document is not traceable, the petitioner shall first approach the jurisdictional police by lodging a complaint stating that the original parent document is missing. The jurisdictional police shall follow the procedure by adhering to the due timelines prescribed under the relevant circular and issue a nontraceable certificate as expeditiously as possible.

5. After obtaining the non-traceable certificate, it will be open to the petitioner to re-present the document, upon which the same shall be registered, if there is no other impediment.

6. With the above observations, this Writ Petition is disposed of. No costs.
