Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents to pay the statutory EPS monthly pension with arrears and interest since 2013 onwards along with ESI medical benefits as per Section 7A of the Employees Provident funds and Miscellaneous Provisions Act, 1952, based on the Petitioners representation dated 04.10.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render Justice.

ORDER
The present writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents to pay the statutory EPS monthly pension with arrears and interest since 2013 onwards along with ESI medical benefits as per Section 7A of the Employees Provident funds and Miscellaneous Provisions Act, 1952, based on the Petitioners representation dated 04.10.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render Justice."
2. Heard Mr.K.Pandia Rajan, learned counsel appearing for the petitioner and Mr.A.Sivasubramanian, learned counsel who takes notice for R1.

Upon hearing the learned counsel appearing for the petitioner and upon perusing the material records of the case, that the grievance of the petitioner is that he was an employee of the 3rd respondent company and upon his superannuation from service, the EPF pension has not been paid to him. Therefore, he sent a representation to the 1st respondent on 04.10.2025. However, no action has been taken till date. Aggrieved by the same, the petitioner is before this Court.
4. According to the petitioner, there is an error in the communication of his Provident Fund amount. The petitioner's amount has been wrongly allocated to a third party, namely Sunil Kumar, who has been granted pension. Therefore, according to the petitioner, under Section 7A of the Act, the 1st respondent is empowered to conduct an enquiry and rectify the said mistake.
5. Considering the limited relief sought for, this writ petition is taken up for final disposal at the admission stage itself. It is made clear that this Court has not expressed any opinion on the merits of the allegations made by the petitioner.
6. In view thereof, the writ petition is disposed of on the following terms:- i. The 1st respondent is directed to take up the representation of the petitioner dated 04.10.2025 for enquiry and thereafter, pass final orders in accordance with law, after due notice to the petitioner, 3rd respondent and the other employee namely D.Sunil Kumar. ii. The aforesaid exercise shall be completed as early as possible, not later than two months from the date of receipt of a web copy of the order, without waiting for the certified copy of the order. iii. No costs.
