O R D E R

This writ petition seeks a writ of mandamus directing respondents 1 to 3 to cancel the patta erroneously changed to the name of the deceased Krishnan (father of the seventh Respondent), who died on 15.09.2000, by proceedings No. 2022/0109/15/013687 dated 27.12.2022 and to restore the patta in the petitioner's name. The Petitioner also seeks a direction to respondents 5 and 6 to delete the entry dated 06.09.2021 relating to the registration of the ex-parte decree in O.S. No.192 of 2017 2/5

on the file of the Additional District Munsif Court, Lalgudi, from the Encumbrance Certificate, based on the Petitioner's representation dated 06.03.2023.

2. When the matter was taken up for hearing, learned Special Government Pleader appearing for respondents 1 to 6 informed the Court that a civil suit in O.S. No. 192 of 2017, relating to the subject property is pending before the District Munsif Court, Lalgudi and that the trial is currently underway.

3. In the said circumstances, the prayer of the petitioner cannot be acceded to, as the issues are now pending before the civil court.

4. Accordingly, this writ petition stands disposed of granting liberty to the petitioner to pursue his remedy before the civil court. No costs.
