O R D E R

The petitioner seeks issuance of writ of Mandamus to direct the respondents 1 and 2 to conduct survey with the help of the third respondent officials.

2. Heard the learned counsel on either side.

3. Considering the limited relief sought for in this writ petition, this writ petition is taken up for final disposal with the consent of either side.

4. The petitioner has made an application for survey of his lands way back on 13.09.2024. The grievance of the petitioner is that despite passage of several months, no survey has been conducted.

5. The learned Additional Government Pleader for the respondents 1 and 2 submits that the respondents has already acted on the representation of the 2/5

petitioner and survey was attempted by the respondents 1 and 2, however, in view of the obstructions by the fourth respondent, survey could not be conducted. Therefore, he submits that sufficient police protection may be given to enable the respondents 1 and 2 to dispose of the petitioner's application, dated 13.09.2024.

In view of the above, the writ petition is disposed of with a direction to the respondents to fix a date for survey and issue advance intimation to the petitioner as well as the fourth respondent and also to the third respondent to enable the third respondent to provide sufficient police protection to the respondents 1 and 2 at the time of survey. The survey shall be conducted in the presence of the parties as well as the police officers. The entire exercise shall be carried out within a period of 8 weeks from the date of receipt of a copy of this order. No costs.
