ORDER : The Court Made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 08.02.2016 by the respondent police for the alleged offences punishable under Section 506(ii) of IPC and Section 4 of Protection of Children from Sexual Offences Act, 2012, in connection with the case registered in Crime No.3 of 2016 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is not involved in any offence as alleged by the prosecution and a false case has been foisted against him. He further submitted that the petitioner is ready to co-operate with the investigation and ready to furnish surety as ordered by this Court. Therefore, the learned counsel prays for enlargement of the petitioner on bail.
3. The learned Additional Public Prosecutor contended that the previous bail petition filed by the present petitioner in Crl.O.P.No.4350 of 2016, before this Court was dismissed on 21.03.2016 and investigation is also pending, if the petitioner is released on bail, it will affect the entire case and prayed for dismissal.
4. In this case, as directed by this Court, the respondent police produced the entire case diary before this Court. On verification of the case diary, 164 Cr.P.C. statement of the victim girl Ramalan Hariba, aged 6 years was recorded by the learned Judicial Officer. On a reading of the same reveals that the petitioner has very seriously abused the victim girl.
