Criminal Appeal filed under Section 14A(2) of Scheduled Castes and Scheduled Tribes(Prevention of Atrocities) Amendment Act, 2015, to set aside the order dated 19.02.2021 passed in Crl.M.P.No.225 of 2021 on the file of the Sessions Judge, Special Court for Exclusive Trial Cases under SC/ST (POA) Act, Sivagangai in Crime No.2 of 2021 dated 24.01.2021 on the file of the first respondent Police.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.AN.Ramanathan, Advocate for the Petitioner and of Mr.P.Kottaichamy, Counsel For State of Government on behalf of the respondents 1 and 2, this Court made the following order: This petition has been filed to relax the condition imposed in CRL.A.(MD).No.121 of 2021, dated 24.03.2021on the file of this Court.
2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this Court in CRL.A.(MD).No.121 of 2021,dated 24.03.2021 regularly and he prayed for relaxation of the said condition.
3.Mr.P.Kottaichamy, learned Standing Counsel for State
appearing for the first and second respondents has strongly opposed to relax the condition.
4.Taking into consideration of the submissions made by both the learned counsel, the condition imposed by this Court in CRL.A.(MD). No.121 of 2021, dated 24.03.2021 is modified to the effect that the petitioner shall appear before the respondent police once in a month i.e., on the first working day of every month at 10.30 a.m. Until further orders. This petition is ordered accordingly.
