Petition filed under Section 482 of the Code of Criminal Procedure to direct the third respondent to register the case on the complaint of the petitioner dated 14.04.2016 and the receipt issued by the third respondent in C.S.R.No.76 of 2016, dated 15.04.2016 on the file of the third respondent therein. ORDER

This petition has been filed seeking a direction to the third respondent to register the case on the complaint of the petitioner dated 14.04.2016 and the receipt issued by the third respondent in C.S.R.No.76 of 2016, dated 15.04.2016 on the file of the third respondent therein.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents. 3.The sum and substance of the complaint of the petitioner is that there was a dispute between the petitioner and one Jenova/proposed accused person and the civil suit filed by the petitioner ended in his favour. While so, the accused persons along with some others has demolished the construction made by the petitioner, thereby violated the order of the civil Court. When it was questioned, they threatened the petitioner and his wife. Hence, a complaint has been given to the respondents. However, no https://hcservices.ecourts.gov.in/hcservices/

action has been taken and hence, the petitioner has filed the present petition.

4.The learned Government Advocate (Crl. Side), on instructions and by producing a report of the respondents, would submit that (a) The proposed accused agreed to remove the fence put up by her illegally ;

(b) The petitioner herein has agreed to take appropriate further proceedings before the civil Court ; and (c) She will not cause any future problem.

Based on this statement made by the petitioner and the proposed accused, the enquiry has been closed.

5. In view of the report submitted by the respondents, this criminal original petition is closed, as nothing survives for adjudication.
