PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to the Respondents 1st and 3rd to give police protection to the life and limb of the petitioner and his family members on the basis of the petitioner`s complaint dated 10.02.2023 and 17.02.2023 and 04.03.2023 and 31.03.2023 within the period stipulated by this Court. This Criminal Original Petition has been filed to the Respondents 1st and 3rd to give police protection to the life and limb of the petitioner and his family members on the basis of the petitioner`s complaint dated 10.02.2023 and 17.02.2023 and 04.03.2023 and 31.03.2023 within the period stipulated by this Court.
2. The learned counsel for the respondents 4 to 7 would submit that in respect of the very same property issue, a Writ Petition has been filed as Public Interest Litigation before the Division Bench of this Court to remove the encroachment made by the private respondents. Based upon the representation dated 31.03.2023, the Division Bench of this 2/5
Court has passed an order, directing to survey the land. The survey was undertaken by the authorities and now report is going to be filed before the Divison Bench of this Court scheduled to hear on 14.06.2023.
3. It appears that the above said Writ Petition was filed on 11.04.2023 on the very same date, this petition has been filed, stating that he wants police protection to measure the property, which will amount to clear process of abuse of Court. Hence, this petition deserves dismissal. The petitioner is at liberty to workout his remedy before the Division Bench of this Court.
4. With the above said liberty, this Criminal Original Petition stands dismissed.
