Respondent/Petitioner/Claimant Prayer :- Civil Revision Petition under Section 115 of C.P.C. to set aside the judgment and decree passed in Fair and Decreetal order passed in E.P.No.29 of 2019 in M.C.O.P.No.71 of 2014 dated 19.04.2021 on the file of the Sub Court, Padmanabhapuram and allow the Civil Revision Petition and thus render justice. ORDER:- This Revision Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.N.Muthuvijayan , Special Government Pleader,for the Petitioner , this Court made the following order:
This is an unfortunate case where a judgment in a motor accident case has been passed on 19.01.2017 and the officials are playing ping pong regarding the deposit of the award amount. 2.By order dated 09.06.2021, this Court had directed that the award amount be deposited within a period of four months from the date of the order. However, not a single stone has moved thereafter.
3.A letter dated 12.05.2021 has been addressed to the Joint Registrar, Kanyakumari, by the Registrar of Cooperative Societies (full additional i/c), 170, Periyar E.V.R.High Road, Kilpauk, Chennai-10, stating that the Joint Registrar's request for making the payment of the award amount is under process. Though the letter 1/3
is dated 12.05.2021, to date not a single penny has been deposited. Thereafter, there is yet another letter from the Registrar of Cooperative Societies to the Additional Secretary to Government, Government of Tamil Nadu, dated 20.11.2021 informing that the time granted by this Court had expired on 09.10.2021 and the sum of Rs.18,01,807/-, requested, be sanctioned at the earliest. Today, we are on 10.12.2021 and the same status regarding the deposit has been maintained.
4.However, taking into account the plea of the learned Government Advocate, this petition is ordered and the petitioner is granted an extension of time finally till 11.01.2022 for depositing the amount as directed by this Court failing which, the Registrar, Cooperative Societies, 170, Periyar E.V.R.High Road, Kilpauk, Chennai-10, and the Joint Registrar, Kanyakumari shall be present before this Court on 12.01.2022.
