ORDER : The Court made the following order :- When the matter was taken up for hearing today, the learned Government Advocate (Crl. Side) appearing for the respondent police submitted that this Court had already granted anticipatory bail to the petitioner on 06.02.2025, and thereafter, the petitioner failed to comply with the conditions imposed by this Court. Thereafter, the petitioner filed an application for relaxation in Crl.M.P. (MD) No. 12911 of 2025, which was dismissed on 04.12.2025. Subsequently, the petitioner again approached this Court by filing an anticipatory bail application in Crl.O.P. (MD) No. 5159 of 2026, which was also dismissed on 11.03.2026, with a further direction to the respondent police to secure the petitioner. Despite the same, the petitioner has once again filed the present application. Hence, this petition is not 2/5
maintainable and is liable to be dismissed.
2.Heard the learned counsel on either sides and perused the materials available on records. 3.This is the third anticipatory bail application. Earlier, this Court had granted anticipatory bail to the petitioner. However, the petitioner failed to comply with the conditions imposed by this Court. Thereafter, he filed an application for relaxation, which was also dismissed. Subsequently, the petitioner filed a second anticipatory bail application and the same was also dismissed. Since the earlier anticipatory bail granted to the petitioner has not been cancelled in the manner known to law, the present application is not maintainable and the previous order dated 06.02.2025 is still in force. Once the petitioner did not comply the conditions, it is the duty of the respondent 3/5
police to file an appropriate application for cancellation of the bail order. However, no application filed to cancel the anticipatory bail granted to the petitioner and no steps have been taken so far to secure the accused. Hence, the present application filed by the petitioner is not maintainable, as this Court has already granted anticipatory bail to him.
4.Accordingly, this Criminal Original Petition stands dismissed.
