Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 20.04.2015 given in respect of the misappropriation of Panchayat fund and malpractice in allotment of free house on merits and in accordance with law and take appropriate action within the time fixed by this Court. ORDER
[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to issue a writ of mandamus so as to direct the first respondent viz., the District Collector, https://hcservices.ecourts.gov.in/hcservices/
Tirunelveli District to look into the representation dated 20.04.2015 alleged to have been given by the petitioner. 2.It is averred in the petition that the petitioner is a native of Thanakkarkulam Village, Radhapuram Taluk, Tirunelveli District, wherein certain houses have been constructed. But in allotment of the same, so many malpractices have been done by the fourth respondent. Under the said circumstances, a representation has been given on 20.04.2015 to the first respondent. But the first respondent has not taken any steps and therefore the present writ petition has been filed for getting the relief sought therein.
3.Considering the nature of the allegations made against the fourth respondent and also considering the fact that already a representation has been given to the first respondent on 20.04.2015 with regard to the alleged malpractice, this Court is of the view to give the following direction to the first respondent.
4.In fine, this writ petition is allowed without costs and the first respondent is strictly directed to look into the representation dated 20.04.2015 and pass necessary orders after giving sufficient opportunity to the persons concerned, within a period of two months.
