PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to rectify the erroneous classification entered in the revenue records including the patta and 'A' register and issue fresh patta in the name of the petitioner and other co-owners in respect of the properties in Survey Nos.812/13, 812/16 to 19, 812/27, 812/28, 812/29 and 812/33 to 36, Seydunganallu Village, Srivaikuntam Taluk, Thoothukudi District in light of the judgement and decree passed in O.S.No.120 of 1998 dated 20.07.1999 by considering the representation dated 28.07.2025 given by the petitioner within the stipulated time fixed by this Court. This petition has been filed seeking to direct the respondents to rectify the erroneous classification entered in the revenue records including the patta and 'A' register and issue fresh patta in the name of the petitioner and other co-owners in respect of the properties in Survey Nos.812/13, 812/16 to 19, 812/27, 812/28, 812/29 and 812/33 to 36, Seydunganallu Village, Srivaikuntam Taluk, Thoothukudi District in light of the judgement and decree passed in 2/6

O.S.No.120 of 1998 dated 20.07.1999 based on the representation dated 28.07.2025 given by the petitioner within the stipulated time fixed by this Court.

2. The learned counsel for the petitioner submitted that the petitioner is the rightful owner of the property in Survey No. 812, based on sale deeds dated 28.02.1983 and 28.03.1984. This claim arose when the respondents attempted to construct police quarters on the property. Consequently, the petitioner filed a suit in O.S. No. 120 of 1998 before the District Munsif Court, Srivaikuntam, praying declaration and injunction. The suit was decreed in favor of the petitioner on 30.07.1999. Aggrieved over the same, the 2nd respondent filed an appeal in A.S. No. 9 of 2000 before the Principal District Court, Thoothukudi, which was dismissed on 29.03.2001. No second appeal was subsequently filed. The litigation had attained finality in the matter, and the petitioner is now seeking reclassification in order to obtain a Patta.

3. The learned Additional Government Pleader appearing for the respondents was filed.

Considering the facts and circumstances of the case, the reclassification issue should be reviewed by both the District Collector (2nd respondent) and the Commissioner of Land Administration (1st respondent). Therefore, the petitioner's application shall be considered by the District Collector (2nd respondent) within 12 weeks from the receipt of this order. If the District Collector (2nd respondent) is not satisfied, the papers shall be forwarded to the Commissioner of Land Administration (1st respondent), who will then review the classification issue. The Commissioner of Land Administration shall complete this review within 8 weeks from receiving the District Collector's report.
