O R D E R

The petitioner states that he is studying B.Sc. (Computer Science and Information Technology) in the fourth respondent College and that he had not been permitted by the fourth respondent College to attend classes on the ground that a criminal case had been registered against him under the provisions of the NDPS Act. The petitioner further states that he has been enlarged on bail and, therefore, seeks a direction to the fourth respondent to permit him to attend the classes. 2/6

2. However, the petitioner states that he was not issued a Hall Ticket by the respondents and, therefore, could not write the 6th Semester B.Sc. (Computer Science and Information Technology) examination.

3. The fourth respondent has filed a counter affidavit stating that, as per the regulations of the Manonmaniam Sundaranar University, attendance up to 60% can be condoned, whereas students having attendance below 60% are required to repeat the course and can appear for the examination only in the next semester. The writ petitioner has secured only 26.60% attendance and, therefore, is not entitled to write the 6th Semester examination. In order to write the examination for the 6th Semester, the petitioner has to repeat the course.

4. In light of the above, the fourth respondent is hereby directed to permit the petitioner to attend the classes for the final year B.Sc. (Computer Science and Information Technology), subject to the petitioner paying the requisite tuition fee and other fees. 3/6
