ORDER

The petitioner seeks for a Mandamus to direct the second and third respondents to conduct enquiry and issue order in respect of an appeal filed by him along with two of his brothers before the second respondent arising out of patta proceedings.

2. Mr.M.Murugan, learned Government Advocate takes notice for the respondents.

3. It is seen that one Ayyavu was granted patta by the third respondent in respect of the land under dispute and aggrieved against grant of such patta, the petitioner and two https://hcservices.ecourts.gov.in/hcservices/

others joined together and filed an appeal before the second respondent in the month of October, 2013.

4. The grievance of the petitioner is that the said appeal, though filed in the month of October, 2013, is yet to be finally decided.

5. Considering the above said facts and circumstances and without expressing any view on the claim made by the petitioner in respect of the grant of patta, I only direct the second respondent to consider the appeal, which is said to be pending before him and pass orders on the same on merits and in accordance with law, also by giving due opportunity of hearing to the opposite party, namely Ayyavu. Such exercise shall be done by the second respondent within a period of twelve weeks from the date of receipt of a copy of this order.
