BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Thursday, the Twenty Eighth day of April Two Thousand Sixteen PRESENT The Hon`ble Mr Justice P.N.PRAKASH CRL OP(MD) No.7144 of 2016 1 RAGAVAN 2 KASIRAJAN 3 HARIHARAN ... PETITIONERS/ACCUSED NOS.2 TO 4 Vs STATE REP BY THE INSPECTOR OF POLICE KANDAMANOOR POLICE STATION, THENI DISTRICT, (CRIME NO.126/2016) ... RESPONDENT/ COMPLAINANT For Petitioner : M/S P.SENGUTTUARASAN Advocate For Respondent : M/S.A.P.BALASUBRAMANI, Government Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehended arrest at the hands of the respondent Police for the alleged offence punishable under Section 306 I.P.C., in Crime No.126 of 2016, on the file of the respondent Police, seek anticipatory bail.
2. Heard Mr.P.Senguttuarasan, learned counsel appearing for the petitioners / accused 2 to 4 and Mr.A.P.Balasubramani, learned Government Advocate (Criminal Side) appearing for the State.
3. On reading of the F.I.R., it is seen that the petitioners herein are land brokers and they obtained a Power of Attorney from one Subbiah for selling his land. After obtaining Power of Attorney, they have not properly given accounts to Subbiah in respect of the sale effected, on account of which, there were lot of disputes between the petitioners and Subbiah's family. Unable to withstand the torture, Subbiah's wife and daughter committed suicide.

4. The learned counsel for the petitioners / accused 2 to 4 submitted that even in the F.I.R., it is stated that only Subbiah's
share has not been settled. This submission cannot be countenanced in view of the fact that the petitioners had obtained Power of Attorney from a poor village labourer and exploited him subsequently.
5. The learned Government Advocate (Criminal Side) submitted that the first petitioner / second accused is an accused in Crime No.401 of 2016, on the file of Veerapandi Police Station.
6. Taking into consideration the serious nature of allegations made against the petitioners / accused 2 to 4, this Court is of the view that this is not a fit case to grant anticipatory bail to them. Accordingly, this criminal original petition fails and it is dismissed.
