This Petition is filed to direct the trial Court to complete the trial in C.C No.1149 of 2023 pending on the file of the learned Judicial Magistrate No.IV, Tuticorin.

2. The grievance of the petitioner is that though this case was registered in the year 2022 and final report was filed in the month of January 2023, the trial has not been proceeded.

3. The learned Additional Public Prosecutor submits that the accused Nos. 4 and 5 in C.C.No.1149 of 2023 have filed an application seeking quashment before this Court in Crl.O.P.(MD)No. 6095 of 2023 and initially, this Court has granted an order of interim

stay. Thereafter, by order dated 15.03.2024, the said Crl.O.P.(MD)No. 6095 of 2023 was dismissed by this Court. The trial Court has to proceed only after the order of this Court in Crl.O.P.(MD)No. 6095 of 2023.

4. Considering the submission made, this Criminal Original Petition is disposed of with a direction to the trial Court to proceed with the trial in C.C.No.1149 of 2023 and to conclude the same as expeditiously as possible, preferably within a period of one year from the date of receipt of copy of this order.
