Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 2nd and 3rd Respondents to provide police protection to the petitioner for demolishing the shops in Door No.144E to 144K situated in VOC Street, Tirunelveli Town, Tirunelveli in compliance of the order passed by the 1st respondent in Na.Ka.No.TP4-2134-2016 dated 14.06.2016. JUDGMENT
[Judgment of the Court was made by M.M.SUNDRESH, J.] When the matter is taken up for hearing today, both the learned counsel for the appellant and learned counsel for the fourth respondent submitted that the Writ Appeal may be disposed of in terms of compromise memo, duly signed by both the parties, dated 7.8.2017.
2.The learned counsel appearing for the respondent No.1 has also got no objection in disposing the Writ Appeal in terms of the compromise memo.
3.We perused the compromise memo, dated 07.08.2017, which is duly signed by both the parties and attested by the learned counsels appearing for the appellant as well as fourth respondent. 4.In such view of the matter, the Writ Appeal stands disposed of in terms of compromise memo. However, we make it clear that this compromise memo will not stand in the way of the Police from proceeding as per law, in the Criminal proceedings, pending against them. The Compromise memo shall form part and parcel of this Order. Consequently, connected Miscellaneous Petition is closed. No costs.
