ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents to survey the petitioner's land in Patta No.2653 bearing Survey No.47/6 measuring an extent of 4 acres and 20 cents situated at Manalur Village, Singampunari Taluk, Sivangangai District, with necessary police protection while conducting such survey, based on petitioner's representations dated 26.12.2024 and 08.03.2025.

2. The petitioner's mother and petitioner's mother's sister, namely Jothimani, had purchased the property and were issued a joint patta in Patta No. 910. Subsequently, the petitioner's parents passed away. Therefore, the petitioner, his siblings, and the legal heirs of the petitioner's maternal aunt are entitled to the property. The said legal heirs are Kasilingam (S/o Napolian), Saravanan (S/o Napolian), Alagumari (W/o Rajan), Aruna (W/o Sakthivel), Manikavasagam (S/o Rengarajan), and Tamil Selvan (S/o Rengarajan).

3. The petitioner had submitted a representation dated 26.12.2024, along with payment of survey charges of Rs.860/-. Subsequently, the petitioner again submitted a representation on 08.03.2025 by remitting a further sum of Rs.860/- towards survey charges. However, the respondents have not conducted the survey 2/5

even after receipt of the said charges. Hence, the present Writ Petition has been filed.

In view of the above, the first respondent is directed to conduct the survey with the assistance of the second respondent, after issuing notice to the petitioner, the aforesaid legal heirs, and any rival claimants, if any. If the first respondent requires any police protection, the same shall be provided by the jurisdictional police station. The official respondents shall adhere to the following Standard Operating Procedures:

• The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 3/5

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
