ORDER

This Criminal Original Petition has been filed for issuing a direction to the 1st respondent to provide police protection to the petitioner based on the complaint given by her, dated 28.03.2023.

2. The petitioner has filed this petition stating that the steps have been taken by the petitioner to remove the encroachment which was made by the private respondents in the Government Poramboke lands, cart track and oorani , which is liable to be removed. The third respondent and others are making life threat to the petitioner.

3. The learned Additional Public Prosecutor would submit that in respect of the very same S.No.297 / 3 civil suit is pending in O.S.No.544 of 2022 on the file of the District Munsif Court, Theni which was filed by the third respondent and others against the village Panchayat of the Government. According to him, in view of the above said suit, there is no possibility to grant of police protection to the petitioner. 2/6

4. The learned counsel appearing for the petitioner submitted that the present S.No.297/3 is not mentioned in the said suit.

5. Whatever may be it is a simple issue between the village panchayat and the villagers, there is no question of life threat to the petitioner. The first respondent is directed to consider the representation of the petitioner and dispose of the same immediately in the light of the above said observation.

6. Accordingly, this Criminal Original Petition is disposed of.
