This petition has been filed seeking direction to the first respondent to transfer the investigation in Crime No.1040 of 2020 is pending on the file of the third respondent police to any other competent police.
2. Heard, the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 to 3.
3.Though it was submitted on the side of the petitioner that the third respondent police did not take any effective steps for securing the accused and for completing the investigation, the submission made by the learned Additional Public Prosecutor reveals the fact that the petition mentioned case is a case of case in counter. According to him, for the same occurrence, another one case has been registered by the third respondent in Crime No.1041 of 2020, in which the petitioner herein was arrayed as a third accused. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.8735 of 2020 4.Therefore, the situation now arises before the third respondent is that he has to follow the Rule 588A of Tamil Nadu Police Standing Orders and proceed with the investigation both in a case and in a counter case.
5.In the said circumstances, if any order is passed in favour of the petitioner that would affect the investigation made by the third respondent. Therefore, I am of the considered opinion that no further order is required in this matter. 6.Accordingly, this Criminal Original Petition is closed.
