ORDER : The Court Made the following order :- The petitioners/A1 to A3 apprehend arrest at the hands of the respondent police for the alleged offence punishable under section 420 of IPC, in Crime No.3 of 2016 on the file of the respondent police and hence, seek anticipatory bail.
2.The learned counsel for the petitioners submitted that this court has already granted anticipatory bail to the petitioners in Crl.O.P(MD)No.5264 of 2016, dated 28.03.2016 and since, the order copy was made ready only 01.04.2016, the petitioners were not able to appear before the concerned Magistrate on or before 16.04.2016. The learned counsel further contended that the 1st petitioner's daughter has admitted in the hospital for pregnancy and due to which, the first petitioner along with other petitioners took care of her and hence, the petitioners could not complied the condition imposed by this court and now, they are ready to comply with the condition that may be imposed by this court.
4.Heard the learned Government Advocate (Criminal side) appearing for the respondent.
5.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners on condition that the petitioners shall pay a sum of Rs.500/- [Rupees Five hundred only] to the Tamil Nadu Legal Services https://hcservices.ecourts.gov.in/hcservices/
Authority, attached to this Bench on or before 03.05.2016 and thereafter, they should appear before the concerned Magistrate on or before 06.05.2016.
6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Nagercoil, Kanyakumari District and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners 2 and 3 shall report before the respondent police daily at 6.30 p.m. until further orders and the first petitioner shall appear before the respondent police as and when required.
