For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.221 of 2020 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379, 511 of IPC r/w. 21(4) of Mines and Minerals (Development and Regulation) Act in Crime No.221 of 2020, seeks anticipatory bail. 2.The case of the prosecution is that on 29.08.2020, the defacto complainant and his assistant found that savudu sand was removed from survey No.45/2B, without any permission. They got permission only for removing excess sand against that, they have removed savudu sand using the vehicles. Therefore, this case came to be registered.
3.The learned counsel for the petitioner submitted that petitioner is only the owner of the vehicle and she has no knowledge about the incident.
4.The learned Government Advocate (Criminal side) for the respondent submitted that 36 accused are involved in this case and https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.7893 of 2021 all the accused are absconding. He further submitted that investigation in this case is not completed.
5.The earlier anticipatory bail petition filed by the petitioner was dismissed on 29.09.2021 on the ground that a huge quantity of savudu sand was removed without any permission. Since the dismissal of the earlier anticipatory bail petition, there is no change in circumstances of the case and hence, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, the Criminal Original Petition is dismissed. sd/- 17/06/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
