Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to dispose of the petition filed by the petitioner pending before him in Na.Ka.No.A4/5260/2014, in accordance with law within a stipulated period fixed by this Court.

ORDER

The petitioner seeks for a Mandamus, directing the 2nd respondent to dispose of the petition in Na.Ka.No.A4/5260/2014 within a time frame.

2.Mr.S.Kumar, learned Additional Government Pleader takes notice for the respondents. By consent, the Writ petition is taken up for final disposal at the admission stage itself. 3.It is stated that the petitioner has approached the 2nd respondent and filed an application, seeking for grant of patta and the said application was numbered in Na.Ka.No.A4/5260/2014. It is further stated that the 2nd respondent has not passed any order so far.

4.According to the learned counsel appearing for the petitioner, it is only the 2nd respondent, who is competent to consider the claim of the petitioner for granting patta. 5.On the other hand, the learned Additional Government Pleader appearing for the respondents submitted that the petitioner should have approached the 3rd respondent first for grant of patta. 6.In any event, as the application of the petitioner is said to be pending before the 2nd respondent, this Court without expressing any view on the claim made by the petitioner, only directs the 2nd respondent to look into the case of the petitioner and pass appropriate orders on the application filed by the petitioner, if the same is still pending, on merits and in accordance with law, if the 2nd respondent has jurisdiction to decide the same.

Otherwise, the 2nd respondent shall forward the said application to the 3rd respondent so as to enable the 3rd respondent to take action on the said application. The said exercise shall be completed by the 2nd respondent within a period of 12 weeks from the date of receipt of a copy of this order. The Writ petition is disposed of accordingly. No costs.
