Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the first respondent to extend the panel of Auditors suitable for promotion as Assistant Audit Officer for the year 2014-2015 in Division VIII(Accounts) Class-II service of Tamil Nadu Electricity Board Service Regulations read with the Tamil Nadu Electricity(Re-organization and Service Regulations read with the Tamil Nadu Electricity(Re-organization and Reforms) Transfer Scheme 2010 for a further period until the petitioner at Serial No.17 in the panel gets the promotion to the Post of Assistant Audit Officer. Though the prayer in the writ petition is widely worded, the learned counsel appearing for the petitioner has submitted that the petitioner will be satisfied, if his representation, dated 08.10.2015, is disposed of by the first respondent on merits and in accordance with law within a stipulated period as fixed by this Court.

2. Heard both sides.

3. According to the learned counsel for the petitioner, a panel, dated 06.12.2014 for promotion to the Post of Assistant Audit Officer, was issued in Tamil Nadu Generation and Electricity Distribution Corporation Ltd., proceedings in (per)CMD TANGEDCO proceedings No.2(A.B), dated 06.12.2014. But the said panel is not acted upon, though the attempt made by some of the employees to stay the said panel was not successful. In spite of the same, the grievance of the petitioner is that the panel is not acted upon. Hence he has made a representation, dated 08.10.2015 to the first respondent to act on the panel and to make promotions based thereon within a stipulated period.

Without expressing anything on merits, in these circumstances, the Writ Petition is disposed of directing the first respondent to pass orders on the representation of the petitioner, dated 08.10.2015 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No Costs. Consequently, connected miscellaneous petition is closed.
