ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 451, 354B and 511 IPC, in Crime No.69 of 2022, on the file of the respondent police, seeks anticipatory bail.

2.Heard both sides.

3.By placing reliance on a medical report, the petitioner claims that he was hospitalized on 29.03.2022 at 12.20 pm and the complaint in Crime No.69 of 2022 is pre-dated since the same was submitted before the jurisdictional Magistrate only on 31.03.2022. 4.The learned counsel for the petitioner would submit that the petitioner was assaulted by the associates of the complainant and the present complaint is the outcome of a revenge. 5.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the petitioner is having one previous case.

6.All the aforesaid aspects require to be further investigated by the respondent police. However, in view of the the prima-facie case on the delayed complaint made, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Vedasandur, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity.

[b]the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of one month and thereafter, as and when required for interrogation.

[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioner shall not abscond either during investigation or trial.

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. sd/- 05/05/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
