ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 4th respondent to pass appropriate order as accordance with law in the objection submitted by the petitioner on 13.02.2024 and the subsequent enquiry conducted on 05.04.2024 for the steps taken by the 5th respondent to create encumbrance by attempting to register the sale deed for the 2/5
properties pertaining to the petitioner and her mother's sister and sister's legal heirs based on the Settlement Deed Doc.No.37/1985 for the land measuring to an extent of 3 Acres 30 cents out of 4 Acres 5 cents comprised in S.No.231/1 situated at Narippaiyur Village, Kadaladi Taluk, Ramanathapuram District pending suit in Filing No.O.S.No.206/2024 before the Learned Sub Court, Ramanathapuram. 2.This Court without expressing any opinion on merits is directing the official respondents to consider the petitioner's claim and pass orders in accordance to law within a period of four weeks from the date of receipt of a copy of this order. If the application is submitted under Section 77(A) of the Registration Act, the official respondents are directed to conduct an enquiry under Section 83 of the Registration Act, after issuing notice to all the parties and thereafter, pass orders in accordance to law within a period of four weeks from the date of receipt of a copy of this order.
3.With the above observations, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
