Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Declaration, to declare the clause 9 of the part C of the Guidelines for admissions in Kendriya Vidyalayas (2020-21 and onwards) uploaded in the official website of the first respondent and the consequential proceedings in Fno.KVD/Admissions/X1/2020-2021 dated 30.07.2020 issued by principal uploaded in the official website of the third respondent as illegal and in violation of the law laid down by the Hon`ble Supreme Court in Principal, Kendriya Vidyalaya and others Vs Saurabh Chaudhary and others reported in (2009) 1 SCC 794 and consequently for a direction, directing the third respondent to admit the petitioner's son in the Commerce Stream in class X1 in the third respondent school in the light of the law laid down by the Hon'ble Supreme Court in Principal, Kendriya Vidyalaya and others Vs Saurabh Chaudhary and others reported in (2009) 1 SCC 794 within the time stipulated by this Court.

ORDER

When the matter is taken up for hearing today, the learned counsel appearing on either side submitted that the petitioner's son has been admitted in Class XI in the third respondent School and therefore, the relief sought for in the Writ Petition has become infructuous and nothing survives for adjudication in the matter. 2.In view of the submission made by the learned counsel appearing on either side, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
