ORDER : The Court Made the following order :- The petitioner is arrayed as sole accused, who was arrested and remanded to judicial custody on 30.03.2016 for the alleged offences punishable under Sections 8(c) read with 22(c) NDPS Act, 1985, in Crime No.190 of 2016, on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that on 30.03.2016, on information the respondent police found the petitioner was in possession of 550 grams of Diazepam. On complaint, case has been registered for the above said offences.

3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner is in judicial custody from 30.03.2016. 4.The learned Government Advocate (Crl.side) filed a counter affidavit and submitted that the the petitioner was in possession of 550 gms of Diazepam, which is a commercial quantity. 5.Considering the facts and circumstances of the case and also considering the fact that the petitioner was in possession of 550 gms of Diazepam, which is a commercial quantity, contention of the learned Govt. Advocate that the petitioner is a notorious criminal and investigation is pending, this Court is not inclined to enlarge the petitioner on bail and accordingly this petition is dismissed.
