PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.not known of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent and the learned counsel appearing for the intervenor.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 366 and 506(2) of I.P.C., in Crime No. not known of 2021 on the file of the respondent police based on the complaint given by the intervenor, seek anticipatory bail.

3.It is not in dispute that as on date no FIR has been registered. Therefore, the question of granting anticipatory bail does not arise. However, to protect the rights of the parties, the following directions are issued:- i) There is no question of orally summoning the petitioners to come to the police station for enquiry. If the respondent wants to enquire the petitioners, only written summons will be issued. ii) If the respondent registers any FIR against the petitioners, the petitioners will be put on notice, so that, the petitioners will have breathing time to move the concerned Court for the relief of anticipatory bail. When such a petition is filed, the petitioners will make the intervenor also as a party to the criminal original petition.
