PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the respondents not to grant separate patta to 4th and 5th respondents as well as other persons by considering the petitioner's representation dated 17.05.2021.

ORDER

(through video conference) Mr. P.Thilak Kumar, Learned Counsel appearing on behalf of the Government of Tamil Nadu, takes notice for the First to Third Respondents.

The Writ Petition has been filed for directing the First to Third Respondents not to grant separate patta to the Fourth and Fifth Respondents as well as other persons on the basis of the representation dated 17.05.2021 made by the Petitioner in respect of the property claimed by him.

Learned Counsel appearing for the First to Third Respondents, on instructions, states that despite notice served on the Petitioner, he had not attended the enquiry on 25.05.2021 conducted in that regard and that the next hearing has been fixed at 11.00 a.m. on 28.06.2021 and that the Petitioner could raise his objections during that enquiry, which would be considered while taking decision. In view of the same, Learned Counsel for the Petitioner states that the Petitioner would attend that enquiry and seeks permission of this Court to withdraw the Writ Petition with liberty to challenge any adverse order that may be passed against him. It is informed that a memo through e-mail would be filed to that effect, which shall be placed on record. In fine, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
