ORDER

It is a petition seeking a direction to the 2nd respondent to register the FIR on the basis of the complaint lodged by the petitioner dated 16.03.2016.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).

3. The case of the petitioner is that despite an order of injunction being granted by the civil Court, the proposed accused committed trespass and he also attempted to dig the land. While his attempt was sought to be prevented, he used abusive language against the petitioner and also committed intimidation. Therefore, a complaint came to be lodged.

4. The learned Government Advocate(Crl.Side), on instructions, would submit that pursuant to the complaint, both parties have appeared before the police and they have given a statement that they will seek assistance of the Surveyor to survey the property https://hcservices.ecourts.gov.in/hcservices/

and to demarcate the same and that they would seek appropriate remedy before the appropriate forum.

5. Recording the submission made by the learned Government Advocate, this petition is closed with liberty to challenge the closure report, if the petitioner chooses to do so.
