Pleased to call for the records relating to the impugned order passed in MC.No.67 of 2021 on the file of the Family Court, Madurai dated 19.11.2021 and to set aside the same as illegal.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KADHAR.S.M, Advocate for the petitioner and of Mr.S.PANDIYARAJ, Advocate on behalf of the Respondents, the court made the following order:- This petition has been filed to condone the delay of 673 days in filing the Crl.R.C. against the impugned order passed in M.C.No.67 of 2021 on the file of the Family Court, Madurai dated 19.11.2021.

2.The learned counsel for the petitioner would submit that the petitioner is ready to pay a sum of Rs.2,00,000/- (Rupees Two Lakhs only) of arrears of maintenance amount and prayed to grant interim stay of the proceedings.

3. In view of the submission made by the learned counsel for the petitioner, this Court is inclined to grant interim stay till the disposal of the criminal revision case on condition that the petitioner has to pay a sum of Rs.2,00,000/- (Rupees Two Lakhs only) of the arrears amount on or before 19.07.2024, before the trial Court, less the amount already deposited failing which, the interim stay already granted stands automatically vacated. The respondents are permitted to withdraw the amount. 2/3
