ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A), 406, 294(b) and 506(ii) of IPC, in Crime No.28 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. The case of the prosecution is that the marriage between the petitioner and the defacto complainant was solemnised on 07.05.2015. After marriage, the defacto complainant ill treated the petitioner both physically and mentally. On her complaint, a case has been registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and prays for anticipatory bail in favour of the petitioner. He further submitted that if the anticipatory bail is granted to the petitioner he will appear before the Court regularly.

4. The learned Government Advocate (Crl.Side) submitted that already charge sheet filed in C.C.No.94 of 2016 and absconding charge sheet is filed and he is not appearing before the Court. This Court by order dated 12.01.2016 granted anticipatory bail to the other accused persons and dismissed the petition against this petitioner.

5.Considering the facts and circumstances of the case and also considering the fact that co-accused were already granted anticipatory bail by this, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate-1, Kuzhithurai, Kanyakumari District, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the concerned Court daily at 10.00 am until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
