Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the official respondents to conduct proper enquiry against the fourth respondent co-operative society and its president who indulged in mal administration, mal practice and fabrication of documents by admitting the new members without the concurrence of the co-operative society by getting huge amount as bribe from the newly added members and consequently attempting to prepare the voters list for the forth coming election in fourth respondent's favour based on the petitioner's representation dated 21.12.2022. The writ petition has been filed in the nature of a Mandamus seeking a direction against the respondents 1 to 3 to conduct necessary enquiry against the fourth respondent / President of Lalgudi Circle Inland Fishermen Co-operative Society.
2. It is stated that with an intention to conduct election for the Society, voters' list is being prepared but, not yet finalized. The petitioner had given a complaint and it would only be appropriate that before the elections are notified in a formal manner the voters' lists are finalized and the grievances of all the members are addressed. That obligation always rest on the respondents 1 to 3. The petitioner had given a representation on 21.12.2022.
3. Let that representation be addressed by issuing notice to the petitioner and also getting clarification and if any allegations have been raised against the fourth respondent, from the fourth respondent and thereafter, the allegations in the representation may be examined and 3/6
necessary orders may be passed. The entire exercise must be completed by the third respondent within a matter of six weeks from the date of receipt of a copy of this order and thereafter, steps for notification of the elections may be commenced in manner known to law.
4. With the above directions, the Writ Petition stands disposed of. No costs.
