Respondents/Petitioners PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to call for the records pertaining to M.C.No.1 of 2016 on the file of the Judicial Magistrate Court Cum Additional Mahila Court, Madurai and quash the same insofar as the petitioner alone.

O R D E R

This petition is filed to quash the proceeding M.C.No.1 of 2016 on the file of the learned Judicial Magistrate Court Cum Additional Mahila Court, Madurai.

2.This Court, while ordering notice on 17.02.2014, granted interim order and the relevant portion of the order reads as follows:

"2. It is seen that Prabhu is the husband of first respondent and father of the second respondent herein. The petitioners herein are his relatives. On the petitioners' ensuring that Prabhu deposits a sum of Rs.7,000/- (Rupees seven thousand only) on or before 5th of every English Calender month to the credit of M.C.No.1 of 2016, before the learned Judicial Magistrate-Cum-Additional Mahila Court, Madurai, as ad interim maintenance, without prejudice to the defence, the personal appearance of the petitioners https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD).No.10951 of 2018 herein, in M.C.No.1 of 2016, is dispensed with. On such deposit, the first respondent / wife is entitled to withdraw the same."

3.Even till today, the petitioner did not comply with the order. Therefore, the petitioners are not entitled to seek any relief before this Court.

4.In the result, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
