The present Criminal Original Petition has been filed by Accused Nos.1 and 2 in Crime No.17 of 2026 on the file of the first respondent, wherein the petitioners are charged with offences under Sections 406, 420, 465, 468, 471 and 34 of IPC.

A perusal of the FIR reveals that the petitioners, who are office bearers of the Trust, said to have entered into a sale agreement on 24.06.2019 for purchasing the property at the rate of Rs.85,00,000/-(Rupees Eighty Five Lakhs only). However, the sale deed reflects that the property has been purchased only for a sum of Rs.35,00,000/- (Rupees Thirty Five Lakhs only). Therefore, in such circumstances, criminal proceedings have been initiated as against the petitioners.

According to the learned counsel appearing for the petitioners, the vendor has received a sum of Rs.85,00,000/- (Rupees Eighty Five Lakhs only) and the sale deed has been executed as per the guideline value and therefore, the petitioners cannot be doubted as the office bearers of the Society bona fide acted in such a manner.

4. Heard the learned counsel appearing for the petitioners and perused the materials available on record.

5. As far as the contentions of the petitioners that actually Rs.85,00,000/- (Rupees Eighty Five Lakhs only) was paid to the vendor of the 3/5

property is concerned, it is the subject matter of the investigation and in such circumstances, no grounds have been made out to quash the FIR at this stage. In such circumstances, there are no merits in this petition.
