Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 420 and 506(i) of IPC in Crime No.103 of 2016 on the file of the respondent police and hence, seeks anticipatory bail.

2. The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition. The said request is rejected.

3. The case of the prosecution is that the petitioner on promising to get a job in Andhra Bank received a sum of Rs.7,38,500/- and his original certificate from the defacto complainant. Subsequently, he did not arrange the job. When the defacto complainant demanded for repayment of money and certificates he refused to give and threatened him with dire consequences.

4. The learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that due to mis-understanding between the petitioner and defacto complainant a false case has been foisted against the petitioner and prays for anticipatory bail in favour of the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. The learned Government Advocate (Crl.Side) submitted that it is a job rocketing and the petitioner has received a sum of

Rs.7,38,500/- and the original certificates and subsequently, he did not return the same. He further submitted that earlier the petitioner filed Crl.O.P(MD).No.7459 of 2016 and the same was dismissed for default on 18.04.2016 and hence, prayed for dismissal of this petition.

6.Considering the serious nature of allegations levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
