PRAYER: The Writ Appeal is filed under Clause 15 of Letters Patents Act, against the order, dated 24.06.2011 passed in WP(MD). No.6661 of 2011.

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF MANDAMUS, directing the 2nd Respondent to implement the Selection Grade and Special Grade Scale of Pay as indicated in Schedule-II of the Tamil Nadu Revised Scales of Pay Rules 1998 at Rs.5000 and Rs.5500 respectively to the Petitioner from 23-09-1985 for Selection Grade and 1996 for Special Grade on the basis of G.O.Ms.No.162 Finance (Pay Cell) Department dated 13-04-1998 and orders of this Honourable High Court in W.P.(MD) No.8611 of 2010 and based on the Petitioner s representation dated 17-08-2010. 2. This Writ Appeal is directed against the order dated 24.06.2011 made in W.P (MD).No.6661 of 2011. The said Writ Petition was filed by the Writ petitioner / respondent herein for direction to implement the selection grade and special grade scale of pay as indicated in Schedule - II of the Tamil Nadu Revised Scales of Pay Rules 1998 as Rs.5000/- and Rs.5500/- respectively to the writ petitioner from 23.09.1985 for selection grade and from 1996 for Special Grade, on the basis of G.O.Ms.No.162 Finance (Pay-Cell) Department, dated 13.04.1998, orders of this Court in W.P(MD).No.8611 of 2010 and based on the writ petitioner's representation dated 17.08.2010.

3.Though the above was the prayer sought for by the respondent /writ petitioner, the writ Court did not grant the same, but only directed to consider the representation submitted by the writ petitioner.

4.The learned Additional Government Pleader submitted that the relief sought for by the respondent herein has been decided in favour of the State and against the employees. 5.If that be so, it is always open for the appellant to pass appropriate orders on the representation submitted by the respondent and communicate the same to the respondent within three weeks from the date of receipt of copy of this order. With these, observations, this Writ appeal is disposed off. No Costs. Consequently, connected Miscellaneous Petition is closed.
