ORDER
This criminal original petition has been filed to direct the learned Principal Sessions Judge, Thanjavur, (Special Court for SC/ST Act Cases) to consider the bail application of the petitioner in crime No.367 of 2021 on the same date of surrender and dispose of the same on its merits in accordance with law. 2.It is seen that the second respondent police registered a case against the petitioner in crime No.367 of 2021 for the offence under Section 294(b) IPC r/w Sections 3(1)(r) and 3(1)(s) of SC/ST Prevention of Atrocities Act, 1989. The petitioner, now seeks a direction of this Court to permit him surrender before the learned Principal Sessions Judge, Thanjavur, (Special Court for SC/ST Act Cases) and consider the bail application on the same day. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.7591 of 2021 3.Taking note of nature of the allegation, this Court is inclined to consider the prayer of the petitioner and the learned Principal Sessions Judge, Thanjavur, (Special Court for SC/ST Act Cases) is directed to consider the bail application to be filed by the petitioner in Crime No.367 of 2021 on the same day of his surrender, on merits. It is needless to say that statutory notice should be given to the defacto complainant/victim. 4.With the above observations, this criminal original petition is disposed of.
