Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C. to direct the first respondent to direct the fourth and fifth respondents to withdraw the investigation in Crime No.231 of 2016 for offence under Section 174 of Cr.P.C and to entrust the same to the Inspector of Police, CBCID, Madurai District. For Petitioner : Mr.R.Udhayakumar For Respondent : Mr.K.Suyambulinga Bharathi 1 to 4 and 6 Government Advocate (Crl.Side)

ORDER

This Criminal Original Petition has been filed seeking for transfer of investigation in Crime No. 231 of 2016.

2. The learned Government Advocate (Crl.Side) would submit that the respondent police have investigated the case and have filed closure report before the learned Judicial Magistrate, Melur on 30.08.2018.

3. It is not clear as to whether any RCS notice was served on the petitioner. The police were also not able to trace any proof for serving such RCS notice on the petitioner.

4. Hence , liberty is given to the petitioner to file protest petition before the learned Judicial Magistrate, Melur against the closure report, if so advised.

5. The Criminal Original Petition is disposed of with the above directions.
