PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, to call for the records of the impugned notice issued by the second respondent dated 26.02.2026 and quash the same.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed this writ petition challenging the eviction notice issued by the second respondent dated 26.02.2026. 2.Mr.J.Ashok, learned Additional Government Pleader, accepts notice for the respondents 1 and 2. In view of the order proposed to be passed in this writ petition, notice to the third respondent is dispensed with.

3.By consent of both parties, this writ petition is taken up for final disposal at the time of admission itself. 4.The contention of the petitioner is that the subject properties were purchased by the petitioner and she is possession and enjoyment of the said property from the date of such purchase. Further, as there were some disputes over the said property between the petitioner and the third respondent, a civil suit in O.S.No.23 of 2029 for declaration is also pending on the file of the District Munsif Court, Dindigul. Even then, the 2/5

present impugned eviction notice has been issued by the authorities concerned treating the petitioner as an encroacher. He further submits that challenging the eviction notice, the petitioner has already filed an appeal before the District Collector and the same is pending for consideration.

5.In such view of the matter, this Court without going into the merits of the matter, directs the first respondent to dispose the appeal filed by the petitioner by considering the original document and after affording an opportunity of hearing to the petitioner, third respondent and any other individual having interest over the subject property within a period of three (3) months from the date of receipt of a copy of this order. 6.With the above direction, this writ petition is disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
