PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing third and fourth respondents to disburse the gratuity amount of Rs.4,64,608/- as per the Final Audit report of staff gratuity as on 31.03.2023 by the second respondent in Na.Ka.17/2026/Tha.Sa dated 16.03.2026 and the same in so for as the petitioner is concerned. O R D E R

The present writ petition is filed for a Mandamus to direct the third and fourth respondents to disburse the gratuity amount of Rs.4,64,608/- as per the Final Audit report of staff gratuity as on 31.03.2023 by the second respondent in Na.Ka.17/2026/Tha.Sa, dated 16.03.2026.

2. the learned counsel for the petitioner submits that the petitioner has retired from service on 31.05.2023. Till now, the respondents have not disbursed the petitioner's gratuity to the tune of Rs.4,64,608/-.

3. The learned Government Advocate submits that there is an Audit 2/5

Objection and hence, there is a difficulty in disbursing the gratuity to the petitioner.

This Court is of the considered opinion that the petitioner has retired in the year 2023 and the respondents cannot endlessly keep the gratuity amount with them without concluding the proceedings, if there is an Audit Objection. Hence, the respondents are directed to consider the petitioner's claim and pass orders as per law within a period of six (6) weeks from the date of receipt of a copy of this order.
