Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings issued by the 1st respondent in Letter Ref. No. SCN/1050042596/2025 dated 10.09.2025 and Letter Ref. No. RVK/1050042629/2025 dated 10.09.2025 and quash them both, and 1/5

consequently direct the respondents to return the petitioner's passport document bearing No. P6259188 within a time frame as may be fixed by this Court, enabling the petitioner to travel abroad.

ORDER

The petitioner challenging the communication dated 10.09.2025 issued by the first respondent.

2. By the said communication, the passport dated 28.09.2017 issued by the petitioner has been revoked citing that the passport contained a fake Malasiyan seal. The petitioner in the enquiry stated that the agent is responsible for the fake seal in the passport. The validity of the said passport has expired and the petitioner has submitted an application afresh for re-issuance of passport. The application is dated 20.09.2025 bearing Reference No. 25-1061741015.

3.Learned Government Advocate(Crl. Side) appearing on behalf of the third respondent, on receiving instructions, submitted that as on today, there is no criminal case is pending against the petitioner in any criminal court of India. Therefore, there is no bar to refuse to re-issue passport to the petitoiner. The refusal to issue passport is governed under Section 6 of the Passport Act. In the absence of any statutory bar, the petitioner's fresh application dated 20.09.2025 has to be considered in accordance with law.

4. Therefore, the Writ Petition is disposed of directing the 2nd respondent shall consider the application dated 20.09.2025 for re-issuance of passport on its own merits and in accordance with law and issue fresh passport if the petitioner satisfies the required criteria.

5. The said exercise shall be completed within a period of four(4) weeks from the date of receipt of a copy of this order. The third respondent is directed to sent a police report to the second respondent in relation to the petitioner's application dated 20.09.2025 for re-issuance of passport within a period of one weeks from the date of receipt of a copy of this order. 3/5
