ORDER

The present writ petition has been filed seeking the issuance of a Writ of Mandamus directing the third respondent to promote the petitioner to the post of PG Tamil Teacher in terms of Rule 28(2)(a)(ii) of the Tamil Nadu Private Schools (Regulation) Rules, 2023, and consequently to direct respondents 1 and 2 to approve such promotion.

2.Mr. N. Sathish Kumar, learned Additional Government Pleader, takes notice for the respondents.

3. By consent of both parties, the writ petition is taken up for final disposal at the stage of admission.

4. The learned counsel for the petitioner submitted that the petitioner has already filed another writ petition in W.P.(MD) No.2134 of 2024 seeking similar relief, and that he is ready and willing to withdraw the said writ petition, provided the third respondent considers his claim for promotion.

5. Recording the said submission, this Court directs the petitioner to file an affidavit before the third respondent stating that he is withdrawing the aforesaid writ petition. Upon receipt of such affidavit, the third respondent shall consider 2/4

the petitioner's claim strictly in accordance with law and pass appropriate orders on merits within a period of six weeks from the date of receipt of a copy of this order.

6. With the above observations, this writ petition is disposed of. There shall be no order as to costs.
