For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.101 of 2021 in the file of the respondent police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 392 IPC in Crime No.101 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that on 20.04.2021, when the defacto complainant along with her husband and child travelling in two wheeler from Pappanadu to Karampakudi, at about 07.50 pm., near Melapatti, a person, aged 30 years wearing white shirt and dark pant, followed them and snatched the gold chain.

The defacto complainant caught hold the chain and hence, the chain was cut, one portion of chain was taken way by the accused. Though her husband chased the accused, he could not succeed. After some time, near Sevvaipatti Pathrakaliyamman hollow block, they found the accused, who met with an accident. The defacto complainant found that the person, who snatched the chain, was taking treatment in the Pudukkottai Government Hospital. Hence, the complaint. https://hcservices.ecourts.gov.

CRL OP(MD)No.7637 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner still taking treatment in the hospital.

4.The learned Government Advocate(Crl.side) appearing for the respondent police strongly opposed this petition on the ground that the snatched chain could not be recovered so far and investigation is pending.

5.Taking note of the fact that the part of the chain alleged to have been snatched by the petitioner is not recovered, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
