ORDER
This Criminal Original Petition has been filed to direct the third respondent to provide adequate police protection to the petitioner and his family members for their life and limb on the basis of the petitioner's representation, dated 18.03.2022.
2.The case of the petitioner is that petitioner is a public-spirited personality and he made a complaint before the District Collector to remove the encroachments made in Kanmai Puramboku in Kallukaranpatti Village. The District Collector issued a notice to the fourth respondent and others to remove the encroachment. In order to wreck vengeance, the fourth respondent and his family members indiscriminately attacked the petitioner. Thereby, the petitioner lodged a complaint before the third respondent police and the same was registered in Crime No.12 of 2022. Thereafter, the petitioner made a representation on 18.03.2022 to the respondents 1 to 3 to issue necessary police protection to the petitioner and his family members. But no action was taken. Hence, the petitioner has filed the present petition with the above said prayer. 2/4
3.The learned counsel for the petitioner would submit that this Court may issue a direction to the third respondent to consider the petitioner's representation dated 18.03.2022 and pass appropriate orders. 4.The learned Additional Public Prosecutor would submit that based on the earlier complaint in Crime No.12 of 2022, the petitioner's representation was considered and the same was closed as "Mistake of fact". Hence, nothing survives for further adjudication in this case. 5.Recording the same, the Criminal Original Petition is dismissed.
