ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 1/4

2. This Writ Petition has been filed for Writ of Mandamus, directing the 1st respondent to give retrospective promotion to the petitioner as Block Development Officer on par with his immediate junior with all monetary and other attendant benefits.

3. The contention of the petitioner is, he has faced disciplinary proceedings for the past six years. The respondents ought to have conducted disciplinary proceedings within the time frame, otherwise the petitioner's right of promotion is affected,

4. By taking the above facts and circumstances of the case, this Court directing the 1st respondent to consider and pass orders, within a period of eight weeks, from the date of receipt of a copy of the order. If on the date of consideraion, then there is no charge memo, the petitioner is entitled for promotion.

5. Accordingly, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
