ORDER

The Criminal Original Petition has been filed praying for a direction to the learned Assistant Sessions Judge, Vallliyoor to dispose of the S.C.No.416 of 2017 within the time stipulated. 2.Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.

3.The learned counsel appearing for the petitioner would submit that after completion of investigation, the respondent police has laid a charge sheet before the learned Judicial Magistrate, Vallliyoor for offences under Sections 279, 294(b), 379, 353 and 307 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation Act) and the same has been taken on file in S.C.No.416 of 2017. Since the case in S.C.No.416 of 2017 has not been disposed of, the petitioner has filed the present petition for the aforesaid relief.

4.The learned Additional Public Prosecutor appearing for the respondent would submit that the case has been posted on 06.09.2018 for prosecution witness and hence, he seeks a specific direction may be given to the Court below to complete the trial https://hcservices.ecourts.gov.in/hcservices/

within a specific time and the petitioner also may be directed to co-operate with the Court below for speedy disposal of the said case.

5.The learned counsel for the petitioner would submit that the petitioner undertakes that he will co-operate with the Court below for early disposal.

6.Recording the aforesaid submission, this Court directs the learned Judicial Magistrate, Vallliyoor, to dispose of the case in S.C.No.416 of 2017 as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order and the petitioner also directed to co-operate with the Court below for speedy disposal of the said case.

7.With the above direction, this criminal original petition is disposed of.
