[Order of the Court was made by R.SUBRAMANIAN, J.] Mr.S.P.Maharajan, learned Special Government Pleader, takes notice for the respondents.
2. With the consent of both sides, the writ petition is taken up for final hearing at the admission stage itself.
3. The petitioner seeks a direction to the revisional authority, viz., the Additional Chief Secretary, Revenue Administration and Disaster Management Department, to dispose of the revision petition filed by him under Section 10A(1) (c) of the Tamil Nadu Land Encroachment Act, 1905. The petitioner had filed the revision before the Commissioner, Land Administration, who had directed the petitioner to approach the Additional Chief Secretary to the Government, since the Government is the appropriate authority under the said provision. Thereafter, the petitioner has filed the present revision.
4. Considering the fact that the matter relates to encroachment, the first respondent, namely, the Additional Chief Secretary, Revenue Administration and Disaster Management Department, is directed to dispose of the revision petition within a period of three months from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. [R.S.M., J.] [L.V.G., J.] 20.06.2023 NCC : No Index : No Internet : Yes PKN
