Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A2 apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 352, 506(i) and 420 of I.P.C., in Crime No.209 of 2018, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner's husband purchased a Hyundai Verna Car bearing Registration No.TN 72 AF 5767 and got loan from TVS Credit Service Ltd on 30.12.2013 to the tune of Rs.3,85,308/- and A1 paid the instalment for 5 months and there is default of payment of loan. Therefore, the petitioner went to the house of the defacto complainant and threatened her. Hence, the complaint.
3.Heard the learned counsel appearing for the petitioners, who would submit that the petitioner stood as a surety and she has nothing to do with the commission of offence and it is only a hypothecation and the complaint has been lodged after one year of the hypothecation.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate No.I, Tirunelveli and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
